Federal Judge Mandates Freedom of Abrego Garcia from ICE Custody

A court has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement lacks lawful basis.

"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been re-detained, again without legal justification," the judge stated in her ruling.

The case stems from a erroneous removal to El Salvador in March, which the government later admitted was an error. After his return to the United States to answer alien smuggling charges, he was detained in federal detention.

In her order, the court noted that the authorities does not have a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."

The legal challenge center on conflicting claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this allegation.
